Generally, the topic of Hobbes's ethics that has received little attention is the "good"1, probably because the critical viewpoint has almost always been from politics and social philosophy; their focus is the justification of rules, obligation, the relationship between natural law and civil law and so on. This paper intends to consider different approaches to the theme of "good" given in the complete works of Hobbes, and not just the politically focused works, to explain the apparent contradictions.

This article introduces the doctrine of the passions in the Hobbesian work, showing its debt with tradition, especially the scholastic Aristotelian one, even if, at the same time, it offers some breach features with this tradition, which are also analysed. In addition, the fundamentals of imagination manifest themselves in the appetitive process, in Hobbes's doctrine as well as in the scholastic Aristotelian tradition, showing their similarities and differences.

The primary purpose of this paper is to show the change in the notion of authority as reflected in Leviathan with respect to De Cive on account of the inclusion, in the former, of the concept of authorization. This notion, which had not appeared in either De Cive or Elements of Law, introduces a new way of conceiving of sovereignty, of power and even of the view on the Kingdom of God. Según la noción clásica el derecho es el objeto de la justicia; también clásicamente se dice que el ius es lo justo, lo debido. Según esto, el ius naturale es lo justo que se funda en la naturaleza y es lo debido por naturaleza. Frente a estas nociones clásicas Thomas Hobbes define al ius naturale como la libertad que cada hombre tiene de usar su propio poder como quiera, para la conservación de su propia naturaleza, es decir, de su vida. También podemos marcar la diferencia entre la concepción clásica de la ley natural como dictamen de la razón práctica que ordena al hombre hacia el fin inscripto en su naturaleza, permitiendo reconocer el bien y el mal afin de realizar el primero y evitar el último, de la noción moderna hobbesiana que concibe la lex naturalis como norma general que obliga a realizar lo que preserve mejor su vida u omitir lo que pueda destruirla o privarle de los medios de conservarla. Undoubtedly, Ewin's view of Thomas Hobbes's moral philosophy offers a fresh counterpart to most current analytical readings of Hobbes by recent American scholars, such as Gregory Kavka and Jean Hampton. Staying close to Hobbes's text, this Australian professor is continuously in debate with these two authors, criticizing their game theoretic reconstruction of Hobbesian philosophy. Ewin's main purpose seems to be the revival of Hobbes's reputation as a moral philosopher.

This paper is one of the four interrelated action agenda papers resulting from the National Summit on Public Health Legal Preparedness convened in June 2007 by the Centers for Disease Control and Prevention and multi-disciplinary partners. Each of the action agenda papers deals with one of the four core elements of public health legal preparedness: laws and legal authorities; competency in using those laws; coordination of law-based public health actions; and information. ZusammenfassungDas Potenzialitätsargument ist das wohl wichtigste Argument der Gegner der verbrauchenden Embryonenforschung und des Schwangerschaftsabbruchs. Weil schon der frühe Embryo eine potenzielle Person sei, so das Argument, besitze er bereits den moralischen Status einer Person. Mit der Möglichkeit, aus differenzierten somatischen Zellen „ethisch unproblematische“ induzierte pluripotente Stammzellen zu gewinnen, schien diese PA-Problematik zumindest für die Forschung umgangen. Indessen zeigen neuere wissenschaftliche Erkenntnisse, dass auch aus pluripotenten Zellen neue Organismen erwachsen können. Der Beitrag argumentiert dafür, dass nach der Logik von PA (...) nicht nur iPS-Zellen, sondern auch die somatischen Zellen, aus denen diese entstehen, als potenzielle Personen mit Würde und Lebensrecht anzusehen wären. Aufgrund dieser Implikationen ist PA auch nicht als Argument für ein Lebensrecht von Embryonen geeignet. (shrink)

ZusammenfassungDie Odysseus-Verfügung ist als besondere Form der Patientenverfügung zumindest in der Literatur hinlänglich bekannt. Die Verwendung des Begriffs und damit sein Gegenstandsbereich sind hingegen noch immer umstritten. Zudem wird oft nicht beachtet, dass es innerhalb dieses Gegenstandsbereichs Varianten von OVs zu differenzieren gilt, die sich auch in ihrer moralischen Rechtfertigung unterscheiden. Nicht zuletzt ist die Grundstrukturstruktur dieser Rechtfertigung umstritten. Vor diesem Hintergrund plädieren wir im Folgenden zunächst für eine Eingrenzung des Begriffs, mit der argumentative und klinisch-praktische Verwirrungen vermieden werden können. (...) Anschließend betrachten wir zwei Varianten von – Zwang legitimierenden – OVs, die sich in der individuellen Kompetenz des Destinatärs unterscheiden. Schließlich zeigen wir, dass deren Rechtfertigung ungeachtet des Umstandes, dass OVs auf Wiedererlangung der Urteils- und Steuerungsfähigkeit des Patienten angelegt sind, weder in einer gemutmaßten noch gar in einer faktischen retrospektiven Billigung von Zwang durch den Patienten liegt. Die primäre Legitimationsgrundlage von OVs besteht vielmehr in der ex ante erfolgenden Autorisierung durch den Betroffenen selbst. Die hier einzuräumende Autorität wiederum basiert auf dem Recht jeder Person auf lebensplanerische Selbstbestimmung. In einem kurzen abschließenden Teil skizzieren wir dann noch die besondere Bedeutung der Odysseus-Vereinbarung als einer Unterform der OV. (shrink)
